Labour Market Impact Assessment (LMIA)

A Labour Market Impact Assessment (LMIA) is a document issued by Employment and Social Development Canada (ESDC) that permits a Canadian employer to hire temporary foreign workers.

A positive LMIA confirms the employer has successfully demonstrated a genuine need for a foreign worker to fill a specific position and that no Canadian worker or permanent resident is otherwise available to be employed for the job.

In most cases, employers must obtain a positive LMIA before a foreign national can apply for a work permit. Common LMIA streams include the high-wage stream, low-wage stream, the Global Talent Stream, and several agricultural programs designed to address seasonal labour shortages.

At Elite Law, our team assists employers at every stage of the LMIA process, including:

  • Assessing eligibility and determining the appropriate LMIA streams

  • Managing job posting and advertising to comply with ESDC requirements

  • Drafting compliant job descriptions and employment contracts

  • Preparing and submitting complete LMIA applications

  • Assist clients in communicating with ESDC after submitting the application

If your business is considering hiring foreign talent, Elite Law Corporation invites you to contact our office at info@elitelawgroup.ca to schedule a consultation. We will assess your situation and provide tailored guidance on what to prepare to proceed with a complete LMIA application at our firm.
